I do apologize for my delay.  I had promised to get back with you and update you on the progress in trying to help secure coverage for the accident we had with Frank Delgado, Saturday at/around midnight (Aug 28/29).  I have the following email from the state of Florida Commissioner of Insurance.  You will see that an investigation by state and federal agencies is underway for the apparent misdealings of the claims handlers and underwriters.   As you can see the Commissioner is asking for a resolution as to their coverage stance and supports for their stance in a very short period of time.  It is our hope that this makes everything move a bit smoother and with less confusion.

As stated previously, my brother and I simply want to get our damages covered.  We have no desire to disturb people trying to make a fair living.  I do not think that you "planned" it to happen, and we didn't plan it either.  We are both victims of an accident.  The thing that disturbs me is the insurance people failing to take proper effective action increases the frustrations and losses potentially for you and I.  Fortunately, if there is such a thing, there is likely an additional opportunity for recovery for both you and I from the misdealings of the claims handlers.  If you wish, I will keep you advised as this develops.  Meanwhile, the process for the state will require I send you some documents this week.  You can anticipate a package that may help us both to resolve this and be in a better position as a result.

Mr. Whidden,

 

Thank you for contacting the Florida Department of Financial Services in regard to the accident you suffered on August 29, 2010.  As an administrative agency, we collect information to identify possible violations of Florida Statute, Florida Administrative Code, or the terms of the policy as issued to the insured.  In the event a possible violation of statute, code, or policy language has occurred, we would then refer the file to the appropriate Division within the Florida Department of Financial Services for further investigation.

In order to initiate the process, we have contacted Aequicap Insurance Company for the current disposition of your claim.  We have requested that they provide all documentation to support their position in this matter.  We are also waiting to hear if they have accepted liability on the part of their insured.  Your written statement, to our Department, indicated this accident happened on August 29, 2010.

Depending on the nature of the overall loss, there may not have been sufficient time for Aequicap Insurance Company to finish their investigation.

In reference to your allegations against the adjusters, we would request that you please forward all written documentation to support your charges.  We would encourage you to continue to seek legal counsel in regard to this matter.  If you wish to pursue a “bad faith” suit against the company, you may want to review our website www.myfloridacfo.com/consumers/civil_remedy.htm for pertinent information on the process in Florida for filing a “bad faith” suit against a company.  Your attorney should also be able to review that process with you.

Please note that Florida Statute 20.121(2)(h)(2) compels all licensees to respond to our inquiries within twenty (20) days.  Therefore, we would anticipate having Aequicap Insurance Company’s response no later than October 17, 2010.  In the interim, please do not hesitate to contact us with any questions that may arise in regard to this matter.
