Thank you for contacting the Florida Department of
Financial Services in regard to the accident you suffered on August 29,
2010. As an administrative agency, we collect information to identify
possible violations of Florida Statute, Florida Administrative Code, or the
terms of the policy as issued to the insured. In the event a possible
violation of statute, code, or policy language has occurred, we would then
refer the file to the appropriate Division within the Florida Department of
Financial Services for further investigation.
In order to initiate the process, we have contacted
Aequicap Insurance Company for the current disposition of your claim. We
have requested that they provide all documentation to support their position
in this matter. We are also waiting to hear if they have accepted liability
on the part of their insured. Your written statement, to our Department,
indicated this accident happened on August 29, 2010. Depending on the
nature of the overall loss, there may not have been sufficient time for
Aequicap Insurance Company to finish their investigation.
In reference to your allegations against the
adjusters, we would request that you please forward all written
documentation to support your charges. We would encourage you to continue
to seek legal counsel in regard to this matter. If you wish to pursue a
“bad faith” suit against the company, you may want to review our website
suit against a company. Your attorney should also be able to review that
process with you.
Please note that Florida Statute 20.121(2)(h)(2)
compels all licensees to respond to our inquiries within twenty (20) days.
Therefore, we would anticipate having Aequicap Insurance Company’s response
no later than October 17, 2010. In the interim, please do not hesitate to
contact us with any questions that may arise in regard to this matter.
